Medico-legal fee benchmarking analysis - Taylor Fry report
Medico-legal services are non-treating assessments conducted by healthcare professionals to provide an expert opinion about a person with an injury. In the NSW workers compensation (WC) and compulsory third party (CTP) schemes, these assessments help to determine the cause and severity of an injury, appropriate treatment, a person’s capacity for employment, and the degree of any permanent impairment.
The State Insurance Regulatory Authority (SIRA) commissioned Taylor Fry to undertake a benchmarking analysis of medico-legal fees in the WC and CTP schemes, following stakeholder feedback that maximum fees are set too low.

Next Steps
The Taylor Fry Report is currently being considered along with other research and information which will inform SIRA’s forward plan in relation to medico-legal services in the NSW WC and CTP schemes.
SIRA will consult with relevant stakeholders on the medico-legal plan in 2024.
